Education cannot be stolen, handcuffed, or imprisoned

Forty some years ago Paulo Freire argued against what he called the banking model of teaching and learning. That was then. Today, the bank  is gone, and a prison stands in its place.

Ask Tanya McDowell or Mireya Gaytan.

Tanya McDowell is a Black woman, a single mother, living with her 6-year-old son. She lives, officially, in Bridgeport. `Officially’ because in fact McDowell is homeless. Or she was last April when she was arrested, in Norwalk, for stealing education. Stealing education is a first-degree larceny offense.

McDowell registered her son in Norwalk, using the address of her babysitter. When this was `discovered’, McDowell was charged with theft. Two weeks ago, she pled out, and was sentenced to five years in jail and five years probation. That’s almost a year for each year of her son’s life.

The public story is `complicated’ by McDowell’s arrests and convictions for selling drugs. Thus, the trial in Norwalk, despite her attorney’s protest, was for both the sale of narcotics and the first-degree larceny, because, somehow, these have to be taken together. That way, it can be demonstrated that Tanya McDowell is not a woman trying to get a decent education for her child. No. She’s a bad mother. She must be. She sells drugs. And she’s not only a bad mother and a drug dealer. She’s Black, homeless, unemployed, underemployed.

The story hearkens to that of Kelley Williams-Bolar, the Black woman in Ohio who was found guilty of stealing education. The story is complicated by the ongoing narratives of the national and regional campaigns to criminalize Black women, and women of color, more generally.

And to criminalize their daughters as well.

Yajira Quezada is eleven years old. She lives, and goes to school, in Colorado. Earlier this week, she got into some trouble with the administration in her schooling, mouthing off or not showing proper respect or deference. So … they called in a counselor. That didn’t work. So … they called in “the school resource officer.” He handcuffed the eleven-year-old girl, took her into his squad car, and delivered her to the juvenile holding facility. As explained by the local sheriff, this is standard operating procedure for `transport’ of juveniles.

This public story is `complicated’ as well.  Children across the United States are subjected to such treatment regularly. School `resource officers’ routinely handcuff children; routinely take them off to juvenile `facilities.’ Children across the country are routinely dumped into `seclusion rooms’. Solitary confinement.  In Georgia, in Wisconsin, children have met their deaths in school-based solitary confinement.

Yajira’s mother, Mireya Gaytan, is outraged. She doesn’t want her daughter to be allowed to misbehave or show disrespect … to anyone. But she also doesn’t want her daughter to be treated as a criminal. In short, she wants her daughter to receive an education.

Tanya McDowell, Mireya Gaytan, two women in America who want their children to receive an education. Not a prison sentence. Not a death sentence. Not a criminal record. Not a trace memory on the wrists. Not a sense of overwhelming vulnerability. Not an indictment based on the color of skin, not a conviction based on where you live … or don’t.

An education.

Education is not merchandise. Those who seek education are not `clients’ or `customers’. They are human beings who know that education is always shared, always social. They are women and girls, and especially women and girls of color, who know that education cannot be stolen, handcuffed, or imprisoned.  Education is a human right, a civil right, a women’s right. Period.

Soni Sori haunts more than India

Sometimes the colonizer becomes the colonist
. For some, this is what has happened to India, specifically as regards land grabs in Ethiopia and elsewhere.

But the transformation doesn’t stop at “colonialism”. Colonialism is more than settlers and mass and brutal extraction of other peoples’ natural resources. Colonialism involves imperialism, empire building, and not only abroad. Welcome to Chhattisgarh … again.

Chattisgarh has been in the news the last few years for a series of “curious adventures” on the part of police, security, and military forces, responding to a purported Maoist “crisis”. Binayak Sen spent three years and some in prison, for no real reason. Earlier this year, Ilina Sen, a prominent feminist scholar and activist, was charged with organizing an international Women’s Studies conference without proper registration of “foreign nationals.” Kopa Kunjam, a Ghandian human rights and development worker, has also been in prison for years for similarly spurious reasons. Himanshu Kumar worked for almost two decades in the jungles of Chhattisgarh, teaching the poorest of the poor how to vote, how to access better food and any health care. His reward? His ashram was burned to the ground, two years ago. As is so often the case, when security forces occupy a zone, they bring sexual violence as part of the package. For women, the price of national security is high.

And so is the price of national “wealth”. Ask Soni Sori, recently arrested last week in Delhi, shipped back to Chhattisgarh, interrogated there, and sent to hospital yesterday, unconscious and with back and head injuries. Police claim she slipped in the bathroom There’s no real evidence against Soni Sori, nothing that actually links her with any Maoist group or identifies her as a Maoist. Instead, there are “suspicions.”

What is going on in Chhattisgarh? The State would tell us that these stories are part of the larger “security” narrative, that there is a Naxalite, or Maoist, emergency in Chhattisgarh that necessitates the infamous state of exception. Dangerous times require dangerous men … with even more dangerous guns and techniques, including torture.

This is not a story of “poverty”. Rather it is a story of wealth. Chhattisgarh is rich in resources, has an extensive forest, and a large tribal population. The women of Chhattisgarh historically have enjoyed a unique position in India … and beyond. The population is more or less equally divided between women and men. Women have participated in every aspect of agricultural production, of labor, and of public life. Chhattisgarh is a place in which gender equity and female subservience have always been in tension.

With the arrival of the global market, that tension has increased. The areas women dominated, in particular that of food security and food sovereignty, don’t carry the same value in a global economy. Both multinationals and the national government have given men positions of authority in the new economies.

Soni Sori is a primary school teacher. Thanks to “security” campaigns, Chhattisgarh has one of the lowest literacy levels in India. State security forces and their paramilitary brethren occupied schools. Then they were attacked by Maoists. The State then closed the schools and moved them to State-controlled areas. For village children, those are impossibly distant areas, both in miles and in culture. And so, literacy levels, never high, plummeted. And what is the shining solution? Build a residential complex, even further away, for the few high school students who are preparing for engineering and medicine.

The rest, and especially the girls, can simply work the fields, build the roads and bridges and malls, watch the distance between rich and poor grow greater and greater, and more and more violent. This is the crisis in Chhattisgarh. Chhattisgarh doesn’t need more troops. It needs more teachers, more schools, more women like Soni Sori. Soni Sori haunts more than India. Soni Sori haunts the world economy.

Gender equality is so “sticky”, says the World Bank

The World Bank this week issued its so-called flagship report, The World Development Report 2012: Gender Equality and Development. The report proclaims that “gender equality is at the heart of development.” It goes on to suggest that progress has been made, but it’s spotty or mixed … or “sticky”. Sticky? In almost 400 pages, that word, “sticky”, is the only surprise.

According to the report, for the past 25 years, women have been ascending … with some exceptions. Here are just some of the exceptions to the rule of women’s improvements.

There are more schools and more students in schools, but the excluded, the ones who never get formal education or receive very little, are still overwhelmingly girls. Globally, more women have entered the formal labor market, but women still make up the vast majority of low-wage job holders. The pay gap between women and men continues, and in some cases widens.

According to the report, “culture” is still a hard nut to crack. Household culture, faith based culture, community culture, you name it. In rich countries and poor, women are still at risk of domestic violence, by commission and omission. Women are under attack, and the State too often refuses to do anything.

In fact, “culture” and “economy” have merged … to the detriment of women. In countries with “shining” economic growth, such as India and China, high maternal and child mortality rates continue, as they do in the United States. Rapid income growth has led to higher levels of sex selection. Women are dying in childbirth, and girls are going “missing”. It’s the price of “progress”.

The report calls these “exceptions” “sticky”. They are either “`sticky’ domains” or “`sticky’ problems.” The quotation marks are the World Bank’s, not mine. Sticky? What does that mean? As a term, “sticky” is never defined, although it begs, screams, for some definition. Here’s how “`sticky’ domain” is defined: “Improvements in some domains of gender equality—such as those related to occupational differences or participation in policy making—are bound by constraints that do not shift with economic growth and development. Gender disparities endure even in high-income economies despite the large gains in women’s civil and economic rights in the past century. These outcomes are the result of slow-moving institutional dynamics and deep structural factors that growth alone cannot address.”

That is precisely the sort of sleight-of-hand that feminists have long criticized.  When it comes to women, according to the Bank, the improvements are fine. Growth, like greed, is good. The internal contradictions, the flaws, such as increased violence and broadening poverty, those are not part of growth. Those are … the signs of a backward culture! And the fact that they’re persistent just means they’re … sticky.

“Sticky” was a perfect word choice, because it accurately describes the mentality of this sort of “gender equality and development.” After all, what takes care of persistent “sticky”? A thorough “cleansing”.

Criminalizing Black Women: Mom Jailed For ‘Stealing An Education’ for Her Children

I have not written about the Kelley Williams-Bolar case previously because I did not have the words to describe how I felt about it. When I first read about the case, I immediately started to tear up and my emotions were in turmoil. I didn’t understand the strong feelings and then I realized that the case recalled ancestral memories of slavery for me. Kelley Williams-Bolar was being accused of “stealing an education” for her children.

Here is some brief background on this case…

Prosecutors in Ohio brought criminal charges against Kelly Williams-Bolar of Akron and her father. The state accused the pair of “allegedly falsifying residency records of two of the woman’s children formerly enrolled in the Copley-Fairlawn City Schools.” The most serious of the charges brought against Ms. Williams was tampering with records which is a “third-degree felony carrying potential penalties of one to five years in prison and a $10,000 fine.” Her 64-year old father was charged with “one count of grand theft for aiding and abetting his daughter in her alleged deception to obtain educational services from Copley-Fairlawn schools.”

Bolar-Williams said her two girls were enrolled in the Copley-Fairlawn school system four years ago — in August 2006, according to court records — over ”safety issues.”

During the trial, several pieces of evidence were presented supporting Ms. Williams’ claims that she was in fact living with her father when she enrolled her children in the suburban school district. However what was also made clear was the lengths to which the school district went to “prove” that she was in fact not a resident in their catchment area:

School officials, according to trial testimony, hired a private investigator in an attempt to document the activities of Williams-Bolar on more than a dozen school mornings.

In several hours of the videotaped surveillance — much of which was shot under cover through a wrought-iron fence — the jury saw Williams-Bolar dropping off her children at a school bus stop within a short walk of her father’s home on Black Pond.

However, when Williams-Bolar took the stand in her own defense on Friday, O’Brien introduced evidence showing that she had 2008 and 2009 W-2 statements from her employer, Akron Public Schools, sent in her name to the address of her father in Copley Township.

Williams-Bolar works as a teaching assistant with special-needs children at Buchtel High School.

The defense also produced 2005 mailed correspondence to Williams-Bolar — more than a year before her children were enrolled in the schools — from the Copley-Fairlawn district. It, too, was sent to her father’s home.

More specific details about the trial can be found here. On January 15th, Ms. Williams was convicted by a jury after 7 hours of deliberation. She was sentenced by the judge to 10 days in jail, three years of probation and community service for falsifying residency records. As if this were not enough, here is more from the judge in this case:

Cosgrove noted Williams-Bolar faces another form of punishment.

Williams-Bolar, a single mother, works as a teaching assistant with children with special needs at Buchtel High School. At the trial, she testified that she wanted to become a teacher and is a senior at the University of Akron, only a few credit hours short of a teaching degree.

That won’t happen now, Cosgrove said.

”Because of the felony conviction, you will not be allowed to get your teaching degree under Ohio law as it stands today,” the judge said. ”The court’s taking into consideration that is also a punishment that you will have to serve.”

Williams-Bolar addressed Cosgrove briefly before being sentenced, saying ”there was no intention at all” to deceive school officials.

She pleaded with Cosgrove not to put her behind bars.

”My girls need me,” she said. ”I’ve never, ever gone a day without seeing them off. Never. My oldest daughter is 16.

”I need to be there to support them.”

Williams-Bolar’s two girls, now 16 and 12, are attending schools elsewhere. They left the Copley-Fairlawn district before the 2009 school term.

Ms. Williams-Bolar was interviewed later and expressed stunned disbelief that she would be jailed for this offense. She believed that if she were convicted she would be sentenced to probation at most.

Kelley Williams-Bolar took an extended pause, pondering as she sat in jail Thursday.

Tears came to her eyes as seconds ticked away. She’s a single mother of two daughters in the middle of a 10-day jail term — a convicted felon — all because of the school the girls attended.

Years ago, she said she took her daughters from Akron’s public housing after their home was burglarized and placed them with their grandfather in Copley Township.

Take a step back to consider everything that is at play in the story of Ms. Bolar-Williams. Here you have a black single mother who was living in public housing with her two daughters. After a traumatic incident of their home being burglarized, she moved her daughters to their grandfather’s home so that they could be safe and attend a good school. A school district spent thousands of dollars to hire a PI to investigate this black woman and her children. Why exactly was this? Are public schools in Ohio so flush with extra cash that they can afford such luxuries? If Ms. Williams and her children had been white would the school have gone to this trouble to expose them as supposed ‘criminals?’ I think that any fair-minded observer would have to say ‘no’. Now we have a tragedy on our hands with lives being destroyed. A 40 year old woman who was putting herself through college to become a teacher is having that dream dashed. What lesson do you suppose her daughters are learning in all of this? Are they learning that America is a just society? Are they learning that they can ‘be anything that they want to be’ when they become adults?

I would say that they have learned a bitter lesson about American INjustice and oppression. This is a form of state violence that the Williams family has been subjected to. Ms. Williams has been accused of defrauding the district for over $30,000 in educational costs because her daughters did not meet the residency requirement. At least four lives have been destroyed over $30,000? Surely that cannot be just!

Apparently this case is causing a lot of controversy in Ohio as well it should. Reporter David Scott writes about some of the reaction. However, I want to point to the words of commentator Boyce Watkins who wrote this:

This case is a textbook example of everything that remains racially wrong with America’s educational, economic and criminal justice systems. Let’s start from the top: Had Ms. Williams-Bolar been white, she likely would never have been prosecuted for this crime in the first place (I’d love for them to show me a white woman in that area who’s gone to jail for the same crime). She also is statistically not as likely to be living in a housing project with the need to break an unjust law in order to create a better life for her daughters. Being black is also correlated with the fact that Williams-Bolar likely didn’t have the resources to hire the kinds of attorneys who could get her out of this mess (since the average black family’s wealth is roughly 1/10 that of white families). Finally, economic inequality is impactful here because that’s the reason that Williams-Bolar’s school district likely has fewer resources than the school she chose for her kids. In other words, black people have been historically robbed of our economic opportunities, leading to a two-tiered reality that we are then imprisoned for attempting to alleviate. That, my friends, is American Racism 101.

This case is a textbook example of how racial-inequality created during slavery and Jim Crow continues to cripple our nation to this day. There is no logical reason on earth why this mother of two should be dehumanized by going to jail and be left permanently marginalized from future economic and educational opportunities. Even if you believe in the laws that keep poor kids trapped in underperforming schools, the idea that this woman should be sent to jail for demanding educational access is simply ridiculous.

In her own words, Ms. Williams said from jail:

”If I had the opportunity, if I had to do it all over again, would I have done it? . . . ,” she said. After almost a half-minute of silence, she answered her own question.

”I would have done it again,” she said. ”But I would have been more detailed. . . . I think they wanted to make an example of me.”

Yes indeed, the state of Ohio wanted to make an example of a black single mother trying to find a way to ensure a successful future for her children by giving them a chance to have a good education… Welcome to America in the 21st century, still racist and unjust.!

CHII CHIRIKUITA : WHAT’S UP?: Six: The Day The Rainbow Fell On The Floor

“Look” she said to me, pointing to the multi-coloured powder paint that had fallen onto the tarmac, “the rainbow fell on the floor.”  She stood there, eyes wide, hands on her hips, her oversized school uniform making her look smaller than her 6 years. 

Then, I watched her skip away, satchel in tow, to the school hall.  Yes, the rainbow had come crashing down from the sky and onto the floor landing in the car park of a private school.

In these, Associated Trust Schools (ATS), parents who are unable to pay school fees see their children excluded:  barred from the classroom, separated from their friends, these sprites are exiled to the school hall. There are many parents who struggle to make the fee payments which range from anything between US$500 – US$1500 per term (3 months) depending on the school.

And the handful of private and state schools where parents can pay large supplements to teachers’ salaries to subsidise the running of the school, are the only ones that are fully functional at the moment. 

But in a bold move this week, the new Minister of Education, Sports, Arts and Culture, David Coltart, announced that no child should be excluded from school for non-payment of fees. Arrangements for payment in instalment now have to be made to ensure that every child no matter the school has access to education.

This is just the beginning of what Mr Coltart, who reported for duty only a month ago, has had to deal with.

From once having one of the highest standards of education in Africa, recording a 72% national O-level pass rate in the mid 1990’s, last year it crashed to 11%.  With the mid 1990 implementation of Economic Structural Adjustment the Zimbabwean government spent less and less on education, so that by 2006 expenditure on education was only 13% of the national budget. By this time hyper-inflation had begun to bite, and it is estimated that in 2008, the value of government spending per child was equivalent to just 18 cents.

The many children in government run schools did not receive an education last year. The Progressive Teachers Union of Zimbabwe estimates that the majority of pupils in the country had a total of 23 days uninterrupted in the classroom.

The academic year should have just been cancelled!

2008 saw teachers go on strike, their salaries worthless, eroded by stagnation and inflation that was officially pegged at 231 million percent.  Many teachers simply could not afford to go to work because their monthly pay was less than the bus fare for the same period.  This, coupled with election violence, the assault of teachers by ZANU PF militia, the looting of schools and the use of some school premises as torture centres dealt the final blow to Zimbabwe’s education system.

And now, virtually all rural schools are closed as well as some urban ones.  Even if they were open and teachers tried to teach the vast majority of schools do not have desks, they do not have textbooks, chalk, exercise books.  Overwhelmed by water and power cuts, buildings are in a state of disrepair and children are adrift.

Nothing is more true than for some of Zimbabwe’s most vulnerable, homeless, hungry and abused:  street kids.   At a workshop held at Streets Ahead, a care and drop-in service for street children, girls write and paint their dreams – murals of beautiful visions of healthy and happy futures.  Here girls and boys can drop in during the day, take a shower, have a meal and engage in activities such as art, drama, craft.  It’s a classroom even though it may not be formally recognised as such, there are many such classroom spaces in and around Zimbabwe, without walls or desks. Its an unidyllic idyll.

The girls talk and discuss as they work. As economic orphans (children are left behind whilst their parents go in search of forex) girl headed households mean that girls shoulder the burden of care.  Sexual violence and rape has meant that many girls now nurse babies. 

But the small people go on with the business of living and learning.  There are many ways to learn, formal and informal and life in Zimbabwe teaches children skills to survive.

No matter where they are located, children always find time to play, run, laugh, have mud fights, right in the midst of everything.  Life always goes on for the living.   Children dream dreams even though the rainbow has fallen out of the sky.

In the formal learning domain, teachers have threatened to go on strike at the end of April 2009 if their salary demands are not met.  Coltart makes no bones of the fact that right now the coffers the empty.  Before he can fund teachers demands, he needs to know how many teachers he has.  There is no computerised database at present and the departments records are apparently in a chaotic state.  In the past few years, many teachers have left Zimbabwe, for jobs elsewhere. It is believed that the number of teachers currently in Zimbabwe is less than 50 percent of a full complement of 140 000.

A think tank comprised of educationalist from various sectors has been put together in order to provide strategic direction and advise in rebuilding and reviving education in Zimbabwe.  The board includes amongst others, former Minister of Education Dr Fay Chung, Zimbabwe Teachers Association President Tendai Chikoore, politician Ms Trudy Stevenson, clergy man Father Joe Arimoso as well as Dr Stanly Hadebe.

Infrastructure is important.  Having the teachers in place is important.  Having the money is important.  But one of the lessons that we can take from history is that it is not enough.  Education is one of those rights that requires active mobilisation, organisation and vigilance.  We have to think outside of the current parameters.  What kind of country do we want?  What kinds of citizens do we want in this country?  What kind of curriculum is going to facilitate that? 

In Zimbabwe today, education includes the participation of everyone from children, women, men, the young and the elderly, everyone has to work to construct new relations and consciousness both inside and outside the classroom.  This includes a broad, relevant and dynamic curriculum, healthy cultures of questioning, debate and critique.  It includes an expanded understanding of what constitutes education.  Participation in seminars, assemblies, walks, volunteer work, acts of solidarity, coming together across the divides to learn and teach reading and writing, to talk and discuss, and more than this, to read and write the reality of life.

This is the hard work.

The work that will reflect and refract a gazillion rainbows in the lives of that six year old little girl standing in the school parking lot and for hundreds and thousands like her all  around the country.
